a truck crashed my kiln building

If you just read the heading and said crap! You are not alone. Late this
afternoon I was notified by the PD of our small community that a pickup
truck had rolled off an embankment next to my building and into my kiln
building. My first question was if anyone was injured, no and my second
question was did it run into my kiln, I was told no to that as well. So we
got in the van and headed to the store. As I rounded the last corner and
could finally see the back of the building, I knew it was much worse than
the officer could know.



Fortunately there were no injuries, because nobody was in the truck. It's
unclear exactly how the truck got loose, but it rolled downhill about 100
yards before it left the street and slammed into my building, only just
missing my propane tank. What the officer didn't know was that the part of
the building the truck ran into was the back of my kiln.



She could only see inside the building enough to see that the big brick box
was still standing. She didn't see that the power burners had been shoved
into the kiln 12", that the trucks bumper had shoved the corner of the kiln
so hard that the entire kiln had moved off it's foundation at least 6", or
that there were about 24 12x24 nitrite bonded shelves in a pile of rubble
inside the kiln along with the arch (I usually leave half of the shelves in
place). The rear wall is bowed in where the hardbrick flue shoved it into
the chamber. In short my 70cf gas kiln is trashed.



If all that was not bad enough, I was informed that he did have insurance -
a special pool policy for people who can't get regular insurance (too many
DUIs, or such like) that has a max property damage value of $15,000 and
guess what, I am told that I have to accept that as total payment for some
reason! The damage to the building will eat most of that.



It is so frustrating that when a guy tries to be an upstanding member of
society and sticks his neck out to build a business, some sleezball who
can't even buy more than charity insurance can just shrug his shoulders and
say "sorry man, I ain't got no money, you can afford to fix it can't you,
ain't you rich?" It was all I could do to just turn around and roll away.



I'll be calling my insurance in the morning and my lawyer, but the one thin=
g
I'm certain of is that he "ain't got no money".

Larry,

This is an opportunity! If, indeed, the property damage is limited to =3D
$15,000 your studio insurance should pick up the rest. I assume that =3D
since your studio is in a building separate from your home you did have =3D
a policy on it. Just let them handle it. The can deal with his insurance =
=3D
and go after him to reimburse them. Build a brand new kiln. Some friends =
=3D
of ours in Tennessee had a similar problem. They have a store/studio =3D
combination. The kiln sat outside in front. One day they watched a car =3D
leave the road and drive right into the kiln. First thought-"is anyone =3D
hurt". Second thought - "great! I get a new kiln." When I saw it it made =
=3D
me wish there was a way someone could run a car into mine. New kilns are =
=3D
just so pretty.=3D20

I know it will be a hassle but in the end you'll have a nice, new kiln =3D
which you designed without all the flaws you found on the one you have.

A driver ran into the back of our car without having insurance at all. =3D
the
State took his driver's license away from him until the debt was paid to =
=3D
the
insurance company.=3D20
=3D20
Hope it all comes out OK if your own insurance company will cough up =3D
some
money.
