and Counterfeits American Crafts=21
Target Stores are selling counterfeit American Crafts, charged the
Made in the USA Foundation in a complaint filed with the International
Trade Commission March 26, 1999. According to the craft artist, T. M. Hoff
of New Paltz, New York, Target Stores ordered one of his pottery lanterns a
few years ago and sent it to China to have cheap copies reproduced.
The Made in the USA Foundation has joined T.M. Hoff Handmade in
filing the complaint with the International Trade Commission. Joel D.
Joseph, chairman of the Foundation said, =22We have let China walk all over
us. China steals our nuclear weapons and missle technology and illegally
copies our intellectual property. From movies and music to software and
even craftwork, China has no respect for our copyrights, trademarks and
patents.=22
According to Hoff, Dayton Hudson (parent of Target) ordered samples
for product evaluation in 1996. Two years later, cheap Chinese copies
began appearing in Target Stores across the United States. Mr. Hoff added:
=22An organization as large as Dayton Hudson should pay a product designer
for the goods they sell. In our case it copied the design of our most
important product and offered us nothing in return. We are a four person
studio business operating out of our home. I guess they thought we were
too small to fight back.=22
The complaint seeks to have the counterfeit goods seized and
destroyed. T.M. Hoff and the Made in the USA Foundation also seek to
prohibit the importation of these counterfeit lanterns. The Foundation
working with the Rosen Group, Inc and AmericanStyle Magazine has
established the American Crafts Project to assist craft artists when their
works are copied overseas.

With all due respect to T.M. Hoff and the Rosen Group, I feel I must speak
up here. The nation, government, and people of China did not steal the
designs of Mr. Hoff. An American corporation did. _Target_ sent the lantern
to a comany in China to be reproduced.
I am very aware of the problems of copyright infringement, of human rights
abuses, and nuclear espionage in China. Let us not forget that our country
has an established, pervasive, and effective program of espionage in other
countries as well. Let us not forget Abner Louwiema (sp?). Remember who
built the trans-continental railroad? Anyone have a good recipe for Temmoku?
I sure do!
I worry that our politicians have decided to turn us on the "dirty Chinee,"
now that the threat of the Russkie is no longer forefront in our collective
phobia. I fear for whomever is next.

Hooray, it is about time someone did something. How about the Aftosa
advertisement in CM. Increase your production, We have connections in China
that will reproduce your ware for pennies. not a direct quote but close
enough. Also this year I had a problem with people coming into my booth and
taking videos and photos of my work. When i would ask them what was going =
on
they would do some =22I'm from a gallery=22 or act like they did not =
understand
English. I have become very blunt at this point like, oh are you going to =
send
these designs off to China where you can get them made for nickles? Another
artist told me she had seen people taking photos with telephoto lens from a
block away.

I'm of two minds about this.
As a writer, I understand the importance of protecting intellectual
property. A guy in Germany represented himself as my foreign agent, sold
my work widely in Europe, and kept the money. I'm out of luck, because he
has no assets worth suing for, and the amount is not large enough to make
the cost of a suit worthwhile.
On the other hand, when it comes to visual arts, and especially an art form
like functional ceramics, with a tradition thousands of years in the making
and a fairly narrow range of acceptable forms, it seems to me to be a
potential can of worms to claim that someone has ripped off an artist's
idea and that this ought to be remedied through government force. The
differences between the work of one potter and the next can often be very
subtle. Though these differences may seem large to the potters involved,
how easy would it be to demonstrate them to a jury?
If the chain of events are as the plaintiffs allege, then I hope Target has
to pay for their unethical actions. However, I wonder how far the process
will go, if this complaint becomes a suit, and this sort of suit becomes
fashionable. Will teachers sue their students? Will Japan sue all the
American potters who make neo-mingei wares?
I just don't know how slippery this slope might turn out to be. I
personally have nothing to worry about, though that's certainly not because
my work is terribly original. It's because I'll never make enough money
selling it to interest the lawyers.
