What does the ethics say? If a slide of a persons work is used in an article
or a book, can one use the work, that is photographed in the slide, for
competition or exhibition purposes again?

Antoinette -
Of course you can. Why in the world would you not be able to do? Even if
you gave or sold the publisher rights to a specific photograph, you did not
give them rights to the work itself, nor to subsequent photographs of the
work. It is still yours. And even if you sold the work to someone, it is
still your work, and you would still have the right to use photographs of
that work however you see fit, unless you had made some kind of contract
releasing all image rights to the owner of the work. I have never heard of
anyone doing that.

What Vince says is true. However there may be times when competition
guidelines stipulate that the work entered must be made within a specific
time frame, usually within a year or two of the competition. Some
competitions also specify that the pieces entered must not have been shown
prior.
It depends on the rules established by the organisation putting on the show.

Janet, Vince, thanks for answering me on this. It did not show on my e-mail
that it was posted. Sorry for posting it twice, I thought there were a
technical problem the first time.
The reason why this question came to my mind, was because I saw the artist
agreement of Lark books. In that they stated that the copyright remains the
right of the artist, but you agree not to publish it elsewhere until 6 months
after the publication of the book. If one would enter into a competition or
exhibition, one often have to agree that your slides might be used for
promotions and often there are catalogues. So if you want to enter into a
competition if your slide of your work is selected, you either have to do so
without giving the exhibitors the rights to use photographs of the particular
piece, or not enter the work until 6 months after the book is published.
That raised the question in my mind, whether it is at all acceptable to use a
piece that was published before, again in an exhibition or competition. I do
understand that you as an artist keeps the rights to your work unless, you
give it away, or sell it, but I am not so sure if it will be acceptable from
an ethical standpoint to use the same piece or image without the approval of
the publisher. Then, how would an exhibitor accept it, if they find out that
a ....maybe a winning piece in the exhibition?..... is publisized in a book
without their approval? On the other hand, maybe an exhibitor might feel that
the publishing of a certain piece, is increasing the value of the exhibition.
I was just wondering how others might see it. I guess the bottom line will
be, to keep the communication open with anyone that you deal with when it
comes to your work and copyrights.
