Hi,
Our guild has an issue we need to address and I was wondering what everyone else out there is doing to handle the issue. The issue is safety for the teachers and students.
Do any of you have the students or teachers sign a waiver, of any kind, releasing the establishment of any liability for accidental injury or illness that may be as a result of participating in classes at the establishment? If you, would anyone be willing to share that information with me. You can send me a copy of the waiver or agreement to my email address off list. I would greatly appreciate it.

It has always been my understanding that releases are not worth the paper
they are written on if an accident happens due to negligence and lawyers are
very clever finding cause that circumvents any blanket release.Clear
adhearance to safety and adequate liablilty coverage is the only insurance.As long as
there are assets/earnings of the institution and individuals to protect it is
a necessary requirement to security.I know this is not what you wish to hear
but it is the reality of our litigious times.

Hi Judy
We have a 3000 sq. ft. teaching facility in NYC. and YES we have everyone
sign a waiver not just about liabilty but also about refunds, conduct,etc. It is
true though if you are negligent your screwed but it good to have something
on file that states you explained how to use equipment and they chose to use
it at their own risk as well as you have the right to ask someone to leave if
they do not follow rules and what the rules are in detail. Especially
nowadays when our society has become so "sue" happy. Origionally we had one rule in
our studio , respect all people and the studio. I very stupidly assumed that
people knew what respect meant. So now I spell out everything and make them
sign it. (We also get there contact information so it helps for the mailing
list.) If you would like to see a copy of our waiver and rule list I would be
more than happy to send it to you off list.
P.S. - The rule list is actually good for a laugh, you would really be
amazed at some of the things we have had to spell out for people.
