My experience is that it would only apply to surface decoration but not to form or
function. Patents are taken out for those.
Answered an add from Pier One Imports for birdhouses once. Less than a year later
they were carrying "my" house made in Bangkok. Looked more like the photo that I
sent than what I was making at the time. A lawyer friend sent them letters to no
avail.
